Terms of Service
Last updated October 11, 2026
These terms are an agreement between your business and Preshift LLC (“Preshift”, “we”, “us”), a New York limited liability company. They cover the Preshift website, the Preshift app at app.dailypreshift.com and everything that comes with it (together, the “Service”). By starting a free trial, creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you’re agreeing on behalf of a business, you confirm you have the authority to do so.
1. The Service
Preshift is a daily briefing console for teams that work in shifts. It lets you build and share a preshift report, keep a library of menus, playbooks and training material, ask Preshift AI questions about your own material, and message your team by email and WhatsApp. The Service is for business use, and you must be at least 18 to create an account.
2. Your account and your team
- The person who sets up the account (the “admin”) controls the workspace: who is invited, their roles, and what is published.
- You’re responsible for everything done under your account, for keeping logins secure and for making sure your team members follow these terms. Tell us straight away at hello@dailypreshift.com if you think someone has accessed your account without permission.
- Keep your account details, including your billing contact, accurate and up to date.
3. Free trial
New accounts can try Preshift free for 30 days, with no card needed. Your account is switched on after a short onboarding call. At the end of the trial you can choose a paid plan to keep going. If you don’t, your workspace is paused and we keep your content for 30 days in case you change your mind, then delete it. Trial features and limits may differ from paid plans.
4. Plans, billing and renewal
- Plans and prices are shown on our pricing page. Fees are charged in advance, monthly or yearly depending on your plan, in US dollars, plus any applicable taxes.
- Subscriptions renew automatically for the same period until you cancel. By subscribing, you authorize us (and our payment provider) to charge your payment method on each renewal.
- We’ll give you at least 30 days’ notice by email before any price change, which applies from your next renewal.
- If a payment fails, we’ll let you know and try again. If it isn’t sorted out within 14 days, we may pause the account until it is.
5. Cancelling and refunds
You can cancel at any time by emailing hello@dailypreshift.com or from your account settings once available. Cancellation takes effect at the end of the period you’ve already paid for, and you keep access until then. Fees already paid aren’t refundable, including for partly used months or years, unless the law requires otherwise or we say so in writing.
6. Your content
- Everything you and your team put into Preshift (reports, menus, notes, files, floorplans, messages and team details) is your content, and you own it.
- You give us permission to store, copy, process and display your content only as needed to run, secure and support the Service for you, including sending it to the service providers listed in our Privacy Policy. We don’t sell your content, and we don’t use it to train AI models.
- You confirm you have the right to upload what you upload, and that it doesn’t break the law or anyone else’s rights.
- When your account ends, you can ask us for a copy of your content within 30 days. After that, we delete it, except where we need to keep something by law or in routine backups that expire on their own.
7. Your team members’ information
As the employer, you decide what information about your team goes into Preshift, such as names, emails, phone numbers and roles. You’re responsible for having a lawful basis for it and for giving your team any notices, and getting any consents, that employment and privacy laws require. Only add a team member’s phone number for WhatsApp messages if they’ve agreed to get them.
8. Team messages (email and WhatsApp)
- Messages and reminders are sent to the people you choose. Only message your own team, and only about work.
- Anyone can stop WhatsApp messages by replying STOP, and we’ll respect that. Standard message and data rates from their carrier may apply.
- WhatsApp messaging runs on Meta’s WhatsApp Business Platform, so its rules apply too. Delivery depends on Meta and mobile networks, which we don’t control.
- No marketing, spam or messages to people outside your team.
9. Preshift AI
Preshift AI answers questions using the material in your workspace. Its answers are generated automatically and can be incomplete or wrong. Treat them as a starting point, not professional advice. Always check anything that matters, and never rely on Preshift AI alone for allergen, dietary, food safety, health, legal or HR decisions. Your manager, your own records and the relevant experts have the final word.
10. Fair use
Each plan includes the limits shown on the pricing page, such as locations, team members and AI questions. Preshift AI and WhatsApp messaging are subject to fair use. If an account’s use is far beyond normal for its plan, we’ll get in touch to find the right plan before taking any other step.
11. Acceptable use
Please don’t, and don’t let anyone else:
- use the Service for anything unlawful, harmful, harassing or discriminatory;
- upload malware or try to break, overload, probe or get around the Service’s security;
- access other customers’ data or someone else’s account;
- copy, resell or rebuild the Service, or scrape it with automated tools; or
- upload sensitive data the Service isn’t meant for, such as payment card numbers, government ID numbers or medical records.
12. Our part
- We work hard to keep Preshift available and secure, but it may occasionally be unavailable for maintenance or reasons outside our control.
- We improve the Service all the time and may add, change or remove features. If we remove something important to your plan, we’ll tell you in advance.
- Support is by email at hello@dailypreshift.com, and we aim to reply within one working day.
13. Other services
Some features rely on other companies’ services, such as WhatsApp, calendar booking and email delivery. Their own terms apply to how you use them, and we aren’t responsible for them.
14. Our intellectual property and feedback
Preshift, its software, design, name and logos belong to Preshift LLC. You get a limited, non-transferable right to use the Service under these terms while your account is active. If you send us ideas or feedback, we’re free to use them without owing you anything.
15. Disclaimer
Apart from what we’ve promised in these terms, the Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. You’re responsible for how you run your business and for the decisions you and your team make using the Service.
16. Limitation of liability
To the extent the law allows, neither of us is liable to the other for indirect, incidental, special or consequential losses, or for lost profits, revenue or data. Our total liability for all claims relating to the Service is limited to the fees you paid us in the 12 months before the claim arose, or $100 if you haven’t paid anything. Nothing here limits liability that can’t be limited by law.
17. Indemnity
You agree to defend and compensate Preshift for claims, losses and costs, including reasonable legal fees, arising from your content, your messages to your team, your breach of these terms, or your failure to meet your obligations as an employer.
18. Suspension and ending the agreement
These terms apply for as long as you use the Service. You can stop at any time (see section 5). We may suspend or close an account that seriously or repeatedly breaks these terms, puts the Service or other customers at risk, or leaves fees unpaid. Where it’s reasonable, we’ll warn you first and give you a chance to fix it. Sections 6 (on deletion), 14 to 17 and 19 continue after the agreement ends.
19. Law and disputes
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. If a dispute comes up, let’s first try to resolve it informally: email hello@dailypreshift.com and we’ll work on it in good faith for 30 days. If that doesn’t settle it, the state and federal courts located in New York County, New York, have exclusive jurisdiction, and we both agree to them.
20. Changes to these terms
We may update these terms as Preshift grows. We’ll post the new version here with a new date and, for significant changes, email the account admin at least 30 days before they take effect. Continuing to use the Service after that means you accept the updated terms.
21. General
These terms, together with the Privacy Policy and any order or plan you sign up for, are the whole agreement between us about the Service. If any part can’t be enforced, the rest still applies. Not enforcing a term right away doesn’t mean we’ve waived it. You can’t transfer this agreement without our consent; we may transfer it as part of a merger or sale of our business. Neither of us is responsible for delays caused by events beyond reasonable control.
